Lawsuit seeks damages in death from high-speed police chase

D’Amore Personal Injury Law, LCC recently filed a lawsuit in Baltimore City Circuit Court alleging negligence, gross negligence and wrongful death against the Maryland Transportation Authority, the agency to which the Maryland Transportation Authority Police Department belongs; several of its officers; the Maryland Department of Transportation; and Michael R. Brown of Hagerstown, Md.

The plaintiffs are seeking damages for the injuries of Rolanda Johnson and Verlonda Johnson-Baker and for the death of Sonjia Johnson-Baker, which occurred Dec. 11, 2015 as a result of a high-speed police chase.

The suit details the Maryland Transportation Authority Police’s pursuit of defendant Brown, which began on Eastern Avenue in Baltimore City and continued for nearly 14 miles reaching speeds of more than 130 miles per hour. The pursuit eventually ended when Brown’s vehicle crossed the I-95 median around mile marker 69.8 and veered into southbound traffic where it collided head-on with Sonjia Johnson-Baker’s car, causing serious injuries that would ultimately result in her death and seriously injuring other passengers in the car.

F. Scott Lucas, the lawyer representing the plaintiffs commented, “This case demonstrates the need for law enforcement to examine its pursuit laws. Had the officers recognized the dangers of pursuing Michael Brown during high-volume traffic and the risk of traveling at such high-speeds, they would have considered the importance of the public’s safety and taken measures to end the pursuit sooner.”
