Child Support Considerations in Maryland

When parents divorce, each parent remains responsible for financially supporting the child. Consequently, child support is an essential part of the child custody case. However, support is not entirely based on custody.

Maryland has statutory child support guidelines which are presumptively correct. The guidelines take into account each party’s monthly gross income, the cost of work-related daycare, the cost of health insurance coverage for the child, extraordinary medical expenses, and the number of overnights each parent has the child. If the number of overnights is greater than 35% (128 overnights) then the calculation is one of shared physical custody. If the overnights are less than 35% (128 overnights) then the calculation is one of sole custody.

Many other factors may come into play when determining child support, but most cases are handled with the application of the guidelines.
